1. Who we are

These terms govern photography and video sessions provided by Roots Photography (“Roots”, “we”), a commercial brand operated by Lucas Maximiliano Serpa. Contact: info@roots.photography — Cerrada Stanyol Mz 6 Lt 22, Int 24, Real Ibiza, C.P. 77723, Playa del Carmen, Solidaridad, Quintana Roo, México. Booking a session, or paying a deposit, means you accept these terms.

2. Booking and deposit

A deposit secures your date and light window. The deposit (currently 30% of the package price) is non-refundable but transferable. Because this condition is disclosed here before you book and you accept it when you pay, the deposit is not returned if you cancel, but it can move to a rescheduled session under section 3.

A transferred deposit stays valid for 12 months from your originally scheduled session date. We use 12 months because it comfortably covers a return trip while keeping the commitment bounded rather than open-ended. If you do not use it within that window, the deposit is forfeited.

3. Rescheduling and cancellation

Rescheduling. With at least 48 hours’ notice you may reschedule once at no charge, and your deposit carries over as described in section 2.

When we refund. We refund the deposit only when we cannot deliver the session:

• Weather that prevents the session and no reschedule is possible within your stay. “Weather that prevents the session” means active rain during the session window, an official storm or hurricane warning from the Mexican weather service (SMN / Conagua), or conditions that make the location unsafe or unreachable. Light overcast is not included — soft light is good light and we shoot in it.
• Force majeure (events beyond our reasonable control, per section 7).
• A cancellation by Roots.

No-show or late arrival. If you do not show up, or arrive late, the session is not extended and no amount is refunded.

4. Payment

The balance (package price minus the deposit) is due on the day of the session, in cash (USD or MXN) or by transfer. Some locations carry third-party costs we do not absorb — a ferry, entry to a protected area, a cenote entrance, or a short transfer to the meeting point. When the spot you choose has one, we tell you the amount before you book; it is billed separately from the package.

5. What you receive

Each package lists its own deliverables. In general: an edited sneak peek within 24 hours, the full edited gallery in about 3 days, and packages that include a scored cinematic Reel in about 5 days, since the film is edited alongside the gallery. Photo counts and inclusions are those shown on the package you book. 24-hour express delivery of the full gallery is available for an extra fee.

6. Image rights and licence

Roots retains the copyright to all photographs and video from your session.

You receive a broad licence to use your images for personal and commercial purposes. For any commercial use, you agree to credit Roots Photography.

Our own use of your images — for our portfolio and social media — requires your separate, express consent, which we collect apart from these terms and which you can decline or withdraw at any time.

7. Minors

When a session includes minors, any release of a minor’s image for our portfolio or social media requires the explicit consent of a parent or legal guardian, identifying who is giving it and in what capacity. We collect this consent separately (for example, on the gallery hand-off). Without it, a minor’s images stay private.

8. Liability and force majeure

We deliver our work with professional care. We are not liable for events beyond our reasonable control (force majeure) — including severe weather, natural disaster, illness, or the failure of third-party venues or services. In any case, and to the maximum extent permitted by applicable law, our liability is limited to the amount you have paid for the session.

9. Privacy

We process your personal data as described in our Privacy Notice.

10. Governing law

These terms are governed by the applicable laws of Mexico, and any dispute will be submitted to the competent courts of Quintana Roo, Mexico. This does not deprive you of any mandatory consumer-protection rights you may have under the laws of your country of residence.
